Inactivity is a ground for terminating enforcement proceedings where, for two years, the creditor has not requested enforcement actions, such as attachment, an inventory, a sale, receipt of funds or a specific application for an enforcement method.
What does this mean for the debtor?
- The enforcement case is terminated by an order of the private enforcement agent.
- Attachments and restraints on property will be lifted by the enforcement agent once the order becomes final.
